Family - Spouse/Partner Visa

Some of the General Requirements

If you wish to bring your spouse / partner to UK to live with you permanently, your partner / spouse (the applicant) must meet the requirements as per Appendix-FM of the Immigration Rules.


As the UK Immigration Rules are very complex (given the fact that there have been thousands of amendments to UK Immigration Rules in the past 10-12 years and continue to be amended) each case needs to be assessed on its own facts. However, below you can see some of the general information about the requirements: 


  • Both the applicant and the sponsor (the partner/spouse of the applicant living in the UK) must be 18 or over;
  • the sponsor must be British or Irish citizen OR have settled status in the UK such as with Indefinite leave to Remain, Settled Status or proof of Permanent residence OR Be from EU, Switzerland, Norway or Lichtenstein and have Pre-Settled Status and must have started living in the UK before 01/01/2021 OR have a Turkish Businessperson visa / Turkish Worker visa OR  have Refugee Status / Humanitarian Protection in the UK.
  • You must be married or have been living together in a partnership for at least two years (unless you are applying for a fiancé / fiancée visa to enter the UK to get married within six months);
  • You must meet the financial requirement i.e. an earning of at least £18,600.00 gross per annum (for the main applicant only without any dependent children applying with the main applicant) by sponsor when applied from abroad; or by the sponsor / the applicant if the applicant is in the UK with a valid permission to live and work in another category and switching into this category, where they are allowed to switch. The financial requirement can be met by the earnings from employment OR self-employment OR through cash savings only if you have cash savings of at least £62,500.00 in your bank account (in the applicant's or the sponsor's or jointly) which have been in the account for a period of full six months prior to date of application.  
  • To meet the financial requirement the funds held as cash savings by the applicant, their partner or both jointly at the date of application can have been transferred from investments, stocks, shares, bonds or trust funds within the period of 6 months prior to the date of application or from the proceeds of the sale of property, in the form only of a dwelling, other building or land, which took place within the period of 6 months prior to the date of application, provided the specified conditions, for these type of funds transferred and held, as per the relevant immigration rules are met, (please contact us to book a consultation to discuss the possibilities of such funds being used to meet the financial requirement, so that we can assess the same for you as per the relevant specified conditions for them);
  • You must meet the English language requirement in Speaking and Listening at A1 CEFR level for first application, unless exempt. Please note the requirement for extension application and ILR application are different;
  • You must be able to prove, through satisfactory documentary evidence that your relationship is genuine and subsisting;
  • Where applicable, you will need to provide a Tuberculosis test certificate from an approved test centre confirming you (the applicant) do not suffer from Tuberculosis;
  • There must be sufficient and adequate accommodation available in the UK for both (the applicant and the sponsor) to live,
  • The applicant must also meet suitability requirements, (they relate to issues such as but not limited to criminal sentences, exclusion / deportation order; false information / representations / documents submitted for any application for a UK visa etc., please contact us should you feel the need to discuss any such issue);
  • The applicant must also meet the Eligibility requirements (contact us to find out what they are).

Scale Up Visa, UK

Scale Up visa - A Work Route to Settlement in UK

If you want to work in the UK and have the right relevant skills, you can apply for this visa to come to UK to work for a scale-up company that has a sponsor licence to sponsor migrants to work in the UK. This is a route to settlement. 


Initial visa is given for two years and then you can apply for an extension for three years (provided you meet the requirements for extension) and after five years you can apply for settlement by meeting the requirements for settlement application.  


You must work for at least six months for your sponsor i.e., in your first job and then you can change job to an unsponsored route. 


The minimum salary requirement is of £33,000.00 per annum or the going rate for the type of work you will be doing, whichever is higher. 


You can also work as a self-employed person but your earnings from self-employment will not be counted to meet the earnings requirement for your extension application later. 


You can also switch into this category if you are already in the UK. Switching is allowed from many categories. 


This is a Point Based System (PBS) category, and you must earn 50 points for CoS which includes job at appropriate level and appropriate salary; 10 points for English Language and 10 points for financial requirement (support / maintenance money).


What you need for this visa: 


  • A confirmed job offer from a UK Scale Up sponsor for at least six months;
  • CoS issued by the sponsor with appropriate job and salary;
  • Knowledge of English at B1 CEFR level in all four components i.e., reading, writing, speaking and listening (understanding);
  • Support money of £1270.00 for the main applicant which should have been in their account for at least 28 days prior to the date of the application, unless certified by their A rated sponsor that they will, if necessary, maintain and accommodate the applicant up to the end of the first month of their employment, to an amount of at least £1270.00. If you are already in the UK and applying to switch into this category and have been in the UK with permission for 12 months or more, you will not need to show these funds.


You must also meet other requirements such as making a valid application, must not have been in breach of immigration laws, not be classed as person not conducive to the public good in the UK due to criminal convictions or any such other conduct, Tuberculosis test requirement where applicable while applying for Entry Clearance etc.


You partner and dependent children are allowed to apply under this category.

UK Ancestry Visa

Visa allowing you to Work and Settle in the UK

If one of your grandparents was born in the UK, you may be able to apply for this visa. 


UK Ancestry Visa allows you to work in the UK and settle after living and working in the UK for five years. A dependant partner and dependant children can apply. The visa will usually be issued for five years and after five years, provided you meet the requirements, you will be eligible to apply for ILR (Indefinite leave to Remain). You are allowed to be self-employed while in the UK on this visa.


What you need: 


  • You must be aged 17 or over, if under 18 parental consent is needed;
  • One of your grandparents must have been born in the UK;
  • You must be able to work and intend to seek and take employment in the UK with some evidence to satisfy the immigration officer, such as a job offer in the UK;
  • Must be a Commonwealth citizen;
  • Must have sufficient money to support yourself (and dependants if any) in the UK without recourse to public funds. A credible promise of financial support from a third party, such as a relative or friend of the  applicant will be taken into account by the Immigration Officer;
  • Must meet the Tuberculosis medical test requirement, if applicable, depending upon the country you are applying from. 


Must meet other suitability requirements such as you not being in breach of immigration laws, your presence in the interest of the public, must not be undesirable in the UK due to any criminal convictions or any such other conduct and you must make a valid application.

Global Talent Visa, UK

A Visa to Work in UK for people with Exceptional Talent or Exceptional Promise.

If you have an Exceptional Talent or can show Exceptional Promise in the field of Science, Engineering, Humanities, Medicine, Digital Technology, or Arts & Culture- you can apply for this visa to come to UK to work and settle. 


Two stages of this visa categories (for most applicants): 


· Firstly, you must apply for an endorsement from a UK organization which is an expert in your field; 

· Once your application is endorsed by a relevant UK body/organization expert in your field, you must apply for an Entry Clearance visa to enter the UK or permission to stay if you are already in the UK.


However, if you have been awarded a Prestigious prize as per the Home Office guidance in Appendix Global Talent: Prestigious Prizes, you do not need to apply for endorsement. 


A dependant partner and dependant children can apply. 


Although the requirements for endorsement may differ for each field, the general requirements as an example, for Arts & Culture are: 


· You must be professionally engaged in producing outstanding performed, presented, distributed or internationally exhibited work;


· Show regular professional engagement in your field for at least last five years;


· Show substantial exceptional talent evidence track record in 1 country or show developing track record in 1 or more countries for exceptional promise;


· Provide three letters of recommendation, two from established Arts & Culture expert organisations (one letter must be from a UK organisation) and third letter from well established Arts & Culture organization with recognized expertise or from such an individual in your field;


· To evidence Exceptional talent, you must provide two of the following three:


(i) Evidence of two or more examples of media recognition from two countries (one can be your own country) for your work as an individual or as a named member of a group; 


(ii) Evidence of winning or significantly contributing to winning an international award for excellence; 


(iii) Evidence from two countries (one can be your own country) of your proof of appearances, performances, publications or exhibitions considered significant internationally, or evidence of extensive international distribution and audiences for the applicant’s work as an individual or as a named member of a group. 


· To evidence Exceptional Promise, you must provide at least two of the following: 


(i) at least 2 examples of recent media recognition for your work as an individual, as a named member of a group or as a contributor from at least one country (can be your own country); 


(ii) evidence of winning, or significantly contributing to winning, or significantly contributing to being nominated or shortlisted for, or being nominated or shortlisted for, an international award for excellence; 


(iii) Proof of appearances, performances, publications or exhibitions recognised in your field, or evidence of international distribution and audiences for your work as an individual, as a named member of a group or as a contributor from at least one country (can be your own country).


Then you must apply for a visa where you will need to gain / obtain 70 points, which can be earned through achieved endorsement - where the endorsing body has issued a letter of endorsement, the date of the application is no more than 03 months than the date of endorsement and the endorsement has not been withdrawn by the endorsing body;  OR 


By gaining 70 points where your application is not relying on endorsement as you have been awarded a prize listed in the Appendix Global Talent: Prestigious Prizes.
